July 30 2004 Dr. Alvaro Castro Estrada Director of Religious Organizations Interior Ministry. I, Carlos Vazques Mendoza, as president of the International Society for Krishna Consciousness in Mexico or the Hare Krishna Movement or its abbreviation “ISKCON”, a Religious Organization, registered with number SGAR/1126/93 before the Interior Ministry on July 13, 1993; and having as mailing address for all kinds of notifications, citations and documents the building located on 45 Gobernador Tiburcio Montiel, San Miguel Chapultepec, Sector Miguel Hidalgo, zip code 11850, Mexico City; hereby authorizing Eusebio Atanasio Gomez Valdes, Esq. for the same matters. With all due respect I present to you the following: Let this letter on behalf of the above organization serve as a request to authorize as abiding by the law that the building located on 15 General Zuazua and which is not alienated and is free of burdens; having its main entrance on 45 Gobernador Tiburcio Montiel, San Miguel Chapultepec, Sector Miguel Hidalgo and folio no. 9436369, and as a result of the subdivision dated July 2, 1993 and actual folio no. 9436369,1, be able to acquire the property in reference for the International Society for Krishna Consciousness or the Hare Krishna Movement or its abbreviation ISKCON, Religious Organization. As long as such structure is susceptible to join the patrimony for Religious Organizations. Please note that this building is used as a Temple by the Religious Organization that I represent. The Direction of Religious Organizations of the Interior Ministry came with us for the declaration of the building mentioned above, recorded on August 10, 1993 with no. 1126/93. Enclosed please find copy of these documents and the originals are kept in your department. We will very much appreciate your input in order to authorize this petition, sending the necessary paperwork so that the Religious Organization that I represent is able to acquire as abiding by Law, the building described above. Religious Organization. 45 Gobernador Tiburcio Montiel San Miguel Chapultepec Sector Miguel Hidalgo Mexico City 11850 In reference to your letter where you request extension to the expiration of the general declaration issued with document no. AR-02/4666/93 dated August 10, 1993, regarding the building located on 45 Gobernador Tiburcio Montiel, San Miguel Chapultepec, Sector Miguel Hidalgo, Mexico City, recorded in the Public Registry of the jurisdiction with folio no. 9436369.1, I take the liberty to inform you the following: In the request of the constitutive registry for the organization represented by you, it was related as a building that was used as susceptible of being incorporated to the patrimony of such religious organization, highlighting that the organization manifested in a unilateral manner and under oath of stating the truth, that it does not have any possessions that are property of the nation. However, after a search in our files, we found file no. 2/45446/342(29), referring to a building that is used, noting that such file is part of the permits of opening to public worship that the Interior Ministry of this Department of the Federal branch and according to the constitutional reforms of January 29, 1992, hereby understands that the already mentioned building was open to public worship prior that date and it is considered as a property of the nation. In the same manner, I want to inform you that in the documents that the Religious Organization presented at the time of the application for the constitutive registry to credit your age in the Mexican Republic, the publication of the magazine: “Back to Godhead” dated September-October 1986 and which shows in the back of the magazine an address named as “Centros Hare Krishna in Mexico”, appears to be related to the building, therefore we can affirm that such building has been used even before the date mentioned above as temple and as such its legal situation would be different that the one manifested in your file. Furthermore, let me inform you that article 17th transitory of the Constitution of the Mexican United States establishes that the temples and other properties that, according to fraction II of article 27 of such Constitution are property of the nation, will maintain its actual legal situation. Also, the article 21 of the Rules for the Religious Organizations and Public Worship establish that only religious association have the right to use exclusively the property of the nation that has been set aside for religious affairs before January 29, 1992 according the referenced article of the Federal Constitution. For all the above, I am informing you that it is not possible to accept your petition since the reasons explained in the building of reference are apparently considered as property of the nation. Therefore, please you will have to visit the Direction of the Federal Patrimony Commission of Assessments and National Real Estate, located at 8 Salvador Novo, Sta. Catarina, CP 04010, Coyoacan, Mexico City, Telephones 55-54-04-56 y 55-54-32-64, so with the object of you collaborate with this Commission for you obtain the supplementary title of domain in favor of the nation of the estate in reference. All the above as found in articles 17th transitory of the Constitution of the Mexican United States; 27, fraction XVIII of the Public Administration Law; 25 and 26 of the Religious Organizations and Public Worship; 1st, 3rd, 20th, 21st, 22nd and 23 of the Rules for the Law of Religious Organizations and Public Worship; 3rd and 8th , fractions VIII and IX of the Rules for the Assessments Commission of National Estates and 2nd, fraction XV, 8th and 24th, fraction V of the Rules of the interior of this Direction.
